attempted to fix this but it's a messy one.. bug #197 were a
direct result of the last attempt to fix for 0094.

the problem is that this is caught up in all the trickiness with size().

maybe we should start requiring size() to be included...

fix is in for 0098, will test with it for a bit before releasing it since
it messes with something so fundamental.
